Fatal car accident in Colorado could lead to civil claims

The second car accident in as many months involving a construction zone near Glenwood Springs has resulted in the death of one person and injuries to four more. This latest fatal car accident may cause the victims' families to investigate whether they have the option of filing civil claims. According to Colorado State Patrol, the car accident happened on Interstate 70 near the Hanging Lake tunnel in Glenwood Springs.On April 29, 2013, in a post titled "Fatal accident in Colorado may lead to wrongful death claims," we told our readers about a head-on collision in Glenwood Canyon on I-70 in a construction zone. That accident claimed the lives of three individuals. According to authorities, this latest accident also involved a head-on collision, this time between a car and a beer hauler.Authorities state that the car was traveling in the eastbound direction when it suddenly moved into the westbound travel lanes. The result was a head-on collision with the beer hauler that had previously exited the tunnel. The car and truck both erupted in flames. Witnesses at the scene of the early morning collision were able to remove three victims from the car. The driver was pronounced dead at the scene.
Reports immediately following the crash did not detail the condition of the other occupants in the car. The driver of the truck was not injured. Near 100 gallons of diesel fuel were spilled onto the roadway during the crash. Authorities are still working to determine exactly why the car moved into the wrong lane.

Construction zones are often dangerous due to narrow lanes, detours, uneven lanes and other factors. With this being the second head-on collision in this area of Colorado roadway, questions may be raised about the functionality and safety of the construction zone. For the victims in this accident, the first step toward recovery may be determining what recourse is potentially available to them under our state's personal injury laws. Under such laws, personal injury or wrongful death claims may be filed against any party deemed negligent in causing or contributing to injuries or death.
