On Behalf of | Sep 28, 2017 | Uncategorized |

Over a hundred injured children have now sought medical attention for serious infections and abscesses in their mouths and necks following dental procedures performed by the Children’s Dental Group in Anaheim, CA, according to news reports. The most prevalent procedure that has been performed causing the injuries was “baby root canals.” Parents are now lining up to file suit against the dental group.

“We have one client – a 4-year-old girl – who has only three teeth remaining,” said a spokesperson for one of the families.1

The following details and allegations surrounding the Children’s Dentist Group were collected from news reports and court documents:

  • Several of the claims say children are currently suffering from life-threatening infections following procedures they didn’t even need.
  • Most of the injuries and subsequent infections were the result of baby root canal procedures.
  • One complaint filed alleges negligence, medical malpractice, medical battery, and false imprisonment.
  • Still more plaintiffs allege that numerous children were exposed to bacteria contaminated water while undergoing unnecessary procedures on their baby teeth.
  • One court document states that children are allegedly strapped to papoose boards or a stabilization board to prevent movement, then given root canals, tooth extractions, or crowns, while parents are kept out of the room.
  • One four-year-old victim and plaintiff has tubes coming out of her chest to help administer strong antibiotics to fight infections in her tissue and bones.
  • Another victim has only three teeth remaining.
  • One family of an autistic child, claims their child underwent unnecessary surgery.
  • Other claims say young patients had multiple procedures without any parental notice, knowledge, or consent.
  • One spokesperson says often low-income, Latino communities are targeted because they have medical coverage.
  • One claim alleges the clinic’s dentists performed anywhere from 80 to 100 procedures each day at a cost of between $500 and $1,000.

Can You Sue a Dentist for Medical Malpractice?

Of course, dentists can be sued. And, here’s what you’ll need to prove:

  • You must prove that you suffered an injury as a result of a careless dentist’s procedure and sub-standard care.
  • The negligence aspect of the medical malpractice case needs to prove four additional things:
    • Duty of Care – Prove the dentist had a duty to care for his patients’ wellbeing and should follow local and industry standards.
    • Breach of Duty – If a dentist fails to provide you a duty of care that is on par with industry or local standards, then there is a breach of duty.
    • Prove Causation – You must prove how your dentist caused your injury. For instance, if your injury would have occurred regardless whether your dentist or another did your dental work, then you may not be able to prove causation.
    • Prove Damages – If you can prove that you were injured by your dentist’s malpractice, then you can bring a case against him.
