Regardless of how many precautions someone takes, a car accident is still possible. Once a car accident occurs, victims and their families are usually in a frantic state of mind. The families are typically in an even more frantic state of mind when the car accident is fatal. In one such case, a fatal car accident occurred in Colorado involving a motorcyclist that may have been speeding and a driver of an SUV that was apparently drinking. Authorities were called out to the scene of a fatal accident that took place between a motorcycle and the driver of a Dodge SUV around 7 p.m. During a preliminary investigation, authorities believe that the driver of the Dodge made a turn right in front of a motorcycle. Unable to avoid collision, the motorcycle crashed into the Dodge.The motorcyclist was declared dead at the scene. The driver of the Dodge was reported to have been drinking prior to the accident and has been investigated to see if he was within legal drinking parameters. The authorities are awaiting results from the test for determination.
As the investigation into this car accident continues, Colorado authorities are likely attempting to determine if any criminal charges should be brought against the driver of the Dodge. Depending on the outcome of the investigation, the driver may encounter a wrongful death claim brought on by family members if it is determined that he or she was in the wrong. On the other hand, if it is determined that the deceased motorcyclist was in the wrong and injuries resulted, the driver may be entitled to pursue a personal injury claim against the estate of the motorcyclist.
