Fatal car accident in Colorado kills unborn baby

On Behalf of | Jul 31, 2013 | Uncategorized |

Drivers may encounter any number of obstacles that could lead to a deadly car accident while driving on the road. These accidents can seem even more devastating when they involve a drunk driver, thus making them preventable. Tragically, a fatal car accident took place just over a year ago, causing the death of an unborn baby just days before it was to be born. The woman who lost her unborn baby in a drunk driving accident last year is seeking an amendment to the constitution which would protect women who are pregnant and their unborn child by regarding unborn children as human beings. This comes after the state of Colorado failed to acknowledge her unborn child as a living human being at the time of the drunk driving accident. She is labeling the amendment as the Brady Act which is what she would have named her unborn child. The woman is vigorously attempting to gain the required amount of 86,501 signatures for the 2014 election in order for the amendment to qualify. Many residents are in support of the Brady Act, including a Pastor from Tri-Town Baptist Church. The drunk driver in this case was charged with DUI and vehicular homicide, but unfortunately took his own life before he was to be sentenced.
This fatal car accident that killed an unborn child may change the laws in Colorado. Depending on the outcome of the Brady Act, an unborn child that is killed in Colorado due to the negligence of another party may be subject to civil litigation. The mothers of any unborn children who die in fatal accidents in the future may have the right to file wrongful death lawsuits against the drivers who are found to be responsible.
